California Consumer Privacy Notice

This California Consumer Privacy Notice (the “Notice”) explains how Remsys, Inc, which operates the Retently customer experience platform (“Retently”, “we”, “us”), collects, uses, and discloses Personal Information about California residents, and the rights available to them under the California Consumer Privacy Act of 2018, as amended by the California Privacy Rights Act of 2020 (together, the “CCPA”).
This Notice supplements the information contained in our Privacy Policy and applies solely to California residents. Capitalized terms not defined in this Notice have the meaning given to them in the CCPA. To the extent there is a conflict between this Notice and our Privacy Policy on the rights of California residents, this Notice controls.
Our two roles
Retently is a customer experience platform that businesses use to collect and analyze customer feedback. Under the CCPA, we act in two distinct roles depending on whose Personal Information is involved:
- As a Business. When you visit our website, request a demo, sign up for an account, or otherwise interact with us directly, we determine the purposes and means of processing your Personal Information. This Notice describes how we handle that information.
- As a Service Provider. When our clients upload or import their own customers’ contact data into the Service to run surveys, we process that data only on our clients’ behalf and under their instructions. In that role, the client is the Business and is responsible for providing privacy notices to, and honoring requests from, their own customers. If you received a survey from a company using Retently and wish to exercise your rights regarding that data, please contact that company directly.
Categories of Personal Information we collect
In the preceding twelve (12) months, we have collected the following categories of Personal Information about California residents acting as a Business. The specific pieces collected depend on how you interact with us.
- Identifiers, such as name, email address, postal or company address, phone number, account username, and IP address.
- Customer records information, such as company name, job title, and billing details (payment is processed by our payment provider; we do not store full card numbers).
- Commercial information, such as subscription plan, products or services purchased, and transaction history.
- Internet or network activity, such as interactions with our website and application, pages viewed, features used, and log data.
- Geolocation data, such as approximate location (country and/or city) derived from IP address.
- Professional or employment-related information, such as your role and the company you represent.
- Inferences, drawn from the above to support product usage analytics and service improvement.
We do not collect Sensitive Personal Information (as defined by the CCPA) for the purpose of inferring characteristics about you, and we do not use or disclose Sensitive Personal Information beyond the purposes permitted under the CCPA that do not trigger a right to limit.
Sources of Personal Information
We collect Personal Information from the following categories of sources:
- Directly from you, when you create an account, contact us, request a demo, or use the Service.
- Automatically, through cookies and similar technologies when you use our website and application.
- From third parties, such as analytics providers, payment processors, and enrichment or lead-data services.
Business and commercial purposes for collection
We collect and use Personal Information for the following purposes:
- To provide, maintain, and secure the Service and your account.
- To process payments and manage subscriptions.
- To respond to your inquiries and provide customer support.
- To send service-related and, where permitted, marketing communications.
- To analyze and improve our website, products, and services.
- To detect, prevent, and respond to security incidents, fraud, and unlawful activity.
- To comply with legal obligations and enforce our agreements.
Disclosure of Personal Information
In the preceding twelve (12) months, we have disclosed the categories of Personal Information listed above to the following categories of recipients for business purposes:
- Service providers and contractors who perform services on our behalf, such as cloud hosting, payment processing, email delivery, analytics, and customer support tooling.
- Professional advisors, such as auditors and legal counsel, where reasonably necessary.
- Government authorities or other parties when required by law or to protect our rights.
We require service providers and contractors to process Personal Information only for the purposes for which it was disclosed and to provide at least the level of privacy protection required by the CCPA.
We do not sell or share your Personal Information
Retently does not sell Personal Information, and we do not share Personal Information for cross-context behavioral advertising, as those terms are defined under the CCPA. We have not sold or shared the Personal Information of California residents in the preceding twelve (12) months. We also do not knowingly sell or share the Personal Information of consumers under sixteen (16) years of age.
Retention
We retain each category of Personal Information for as long as reasonably necessary to fulfill the purposes described in this Notice, unless a longer retention period is required or permitted by law. Retention periods are determined based on the type of information, our legal and contractual obligations, and our legitimate business needs.
Your rights under the CCPA
If you are a California resident, you have the following rights regarding your Personal Information, subject to certain exceptions:
- Right to know. You may request that we disclose the categories and specific pieces of Personal Information we have collected about you, the categories of sources, the business or commercial purpose for collecting it, and the categories of third parties to whom we disclosed it.
- Right to delete. You may request that we delete Personal Information we have collected from you, subject to legal exceptions.
- Right to correct. You may request that we correct inaccurate Personal Information we maintain about you.
- Right to opt out of sale or sharing. Because we do not sell or share Personal Information, there is no need to opt out; however, you retain this right should our practices change.
- Right to limit use of Sensitive Personal Information. Because we do not use Sensitive Personal Information for purposes that trigger this right, no action is required; this right is preserved should our practices change.
- Right to non-discrimination. We will not discriminate against you for exercising any of your CCPA rights.
How to exercise your rights
To submit a request to know, delete, or correct, you may contact us at [email protected]. Please include enough detail for us to understand and respond to your request.
We will need to verify your identity before responding. Verification may require you to provide information that matches what we already hold about you, such as the email address associated with your account. We will not fulfill a request unless we can reasonably verify that you are the person about whom we collected Personal Information.
You may use an authorized agent to submit a request on your behalf. We may require the agent to provide proof of authorization and may still require you to verify your own identity directly with us.
We will confirm receipt of a verifiable request within ten (10) business days and respond within forty-five (45) calendar days. If we need more time, we will inform you and may take up to an additional forty-five (45) days, for a maximum of ninety (90) days from receipt of the request. There is no charge to make a request unless it is excessive, repetitive, or manifestly unfounded.
Shine the Light
California’s “Shine the Light” law (Civil Code section 1798.83) permits California residents to request information about the disclosure of certain Personal Information to third parties for their direct marketing purposes. We do not disclose Personal Information to third parties for their own direct marketing purposes.
Changes to this Notice
We may update this Notice from time to time to reflect changes in our practices or applicable law. When we make material changes, we will revise the “Last updated” date at the top of this Notice and, where required, provide additional notice.
